These Terms of Use govern your use of the GrindLevel website and application (the “Service”), operated by ANA SOFTWARE LLC.

The Service

GrindLevel helps you organize dealership commission information, pay-plan details, deals, goals, and related records. It is a personal recordkeeping tool, not payroll, tax, legal, or financial advice. You are responsible for confirming compensation with your employer and official payroll records.

Accounts and acceptable use

You are responsible for keeping your account credentials secure and for the information submitted through your account. Do not misuse the Service, interfere with its operation, attempt unauthorized access, or use it in violation of applicable law.

Pro subscriptions and store billing

GrindLevel Pro is an auto-renewable subscription sold through Apple’s In-App Purchase system on iOS and Google Play’s billing system on Android. The available plans, subscription duration, and localized price are shown in the app and confirmed by the applicable store before purchase. If an introductory offer is shown, its eligibility, duration, and renewal price are also confirmed by that store.

For App Store purchases, payment is charged to your Apple Account when you confirm the purchase. Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. You can manage or cancel it in your Apple Account subscription settings. GrindLevel can restore a subscription previously purchased with the same Apple Account.

For Google Play purchases, payment is charged to your Google Play account under the terms shown by Google Play. The subscription renews unless you cancel it in the Google Play subscription center. GrindLevel can restore an eligible subscription associated with the same Google Play account. Uninstalling GrindLevel does not cancel a Google Play subscription.

Apple or Google Play administers billing and refund requests for purchases made through its store, subject to its policies and applicable law. Deleting a GrindLevel account does not cancel a store subscription. If Pro access ends, your existing GrindLevel data remains visible and exportable; adding or changing sales, goals, spiffs, or pay plans may require an active subscription or trial.

License to use GrindLevel

We grant you a limited, non-exclusive, non-transferable, revocable license to use GrindLevel for your own personal or internal business purposes. On Apple devices, this license permits use on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that GrindLevel may be accessed by other accounts associated with you through Family Sharing or volume purchasing where applicable. You may not sublicense, resell, reverse engineer, or redistribute the Service except as permitted by applicable law.

Support and maintenance

ANA SOFTWARE LLC is solely responsible for providing any maintenance and support for GrindLevel. Apple has no obligation whatsoever to furnish any maintenance or support services for GrindLevel. Support requests may be sent to [email protected].

Warranty and disclaimer

To the maximum extent permitted by applicable law, GrindLevel is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. ANA SOFTWARE LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.

In the event of any failure of GrindLevel to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you, if any. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to GrindLevel, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of ANA SOFTWARE LLC.

Product claims

ANA SOFTWARE LLC, and not Apple, is responsible for addressing any claims by you or any third party relating to GrindLevel or your possession and use of it, including but not limited to product liability claims, any claim that GrindLevel fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation, including in connection with GrindLevel’s use of the HealthKit and HomeKit frameworks.

Intellectual property

GrindLevel, including its software, design, and content, is owned by ANA SOFTWARE LLC and is protected by intellectual property laws. In the event of any third party claim that GrindLevel or your possession and use of it infringes that third party’s intellectual property rights, ANA SOFTWARE LLC, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim. The data you enter remains yours; these terms grant us no ownership of it.

Third party terms

You must comply with any applicable third party terms of agreement when using GrindLevel. This includes, where relevant, the terms of your Apple Account and App Store purchases, your Google account and Google Play purchases, and the terms governing your wireless data plan.

Legal compliance

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple

These terms are concluded between you and ANA SOFTWARE LLC only, and not with Apple. ANA SOFTWARE LLC, not Apple, is solely responsible for GrindLevel and its content. You acknowledge and agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of these terms, and that upon your acceptance of these terms Apple will have the right, and will be deemed to have accepted the right, to enforce these terms against you as a third party beneficiary of them.

Changes and availability

We may update the Service or these terms as the product evolves. We will post an updated date when these terms change. To the extent permitted by law, the Service is provided as available.
